The Broadcasting Complaints Commission will rule in two weeks' time on whether lyrics of a song entitled Get Out by Johannesburg-based rapper, Zubz, constitute hate speech.

This follows a complaint lodged by the Freedom Front Plus to the BCCSA about the continued screening of it by SABC 1.

A hearing was conducted on Thursday at the BCCSA where Freedom Front Plus MP, Willie Spies, said the screening of the Get Out music video by SABC 1 in January this year, amounted to the contravention of the BCCSA's Code of Conduct.

Spies said SABC 1 was in contravention of the BCCSA's code which provides that licensees may not broadcast "propaganda for war; incitement of imminent violence; or advocacy of hatred that is based on race, ethnicity, gender or religion, and that constitutes incitement to cause harm".





'My lyrics have been taken out of context'
The song - which was released in 2006 - contains lyrics which include lines like: "Tell the oppressor get out. And tell my people fight. For real you need to watch out. Because you feel the gun blast" (to machine gun sounds in the background.)

The Zimbabwean-born, BCom graduate continues: "Understand I'm gonna get this panga to your neck. Take what is mine today and I'll rob you tomorrow. Take my time it's payback. Tell my people fight. And tell the oppressor get out."

Spies said the "music video contains statements which, judged within context sanction, promote and glamourise violence based on race, national and ethnic origin".

Spies said in his opinion "the broadcast of this music on national television of a country plagued by racially motivated attacks and murders, is not only inappropriate but also irresponsible and inexcusable".

The registrar of the BCCSA, Shouneez Martin, said the hearing had taken less than 45 minutes and a decision would be taken in about two weeks.

Commenting on the hearing, Zubz said on Wednesday night: "My lyrics have been taken out of context. If you follow my music career over the past 10 years, you will see that I do not condone hate speech or violence.

"In that song I use the struggle and the oppression we had in this country as a pretext for people to stand up for what they believe in.

"When the complaint came up, information leaked out before the hearing and I was vilified for my lyrics."

He said people misunderstood the words, adding he would wait for the outcome of the hearing before commenting further.

I'm all for freedom of speech and political self-expression...
And I'm all for the condemnation of hate speech...

But who in their right mind gives a FLYING f*** about what the Freedom Front thinks? ;D ;D ;D

The original Fela song had almost the exact subject matter and feel as the Zubz song. So in that regard i can see how the beat evoked that same emotion, the beat is a bit militant.

The times have changed and oppression is not as blatant or visible as it was once before. I think some of the Anti "Get out" arguments are reasonable, in the sense that they dont have any real reference to base their views on but the actual song and the words in it. Their right to question it because you can never underestimate the power of words. However harmless they may seem to you.

But they did really take it out of context because I know Zubz's character and know he is not the type of person to promote hate speach. Plus i listen to the song as a black man, within the context of hiphop and expression, the FF+ doesnt have that frame of reference.

They just focus on the words in the song, without taking the context into consideration, and unfortunately they came to this conclusion. Cant really fault them for feeling the way they do, i really hope all of this has came about from genuine feelings of concern as opposed to them trying to use Zubz as a scape goat to make a political statement.

I knew this would happen. 2 years later, people are still talking about this album. Not based on the closeness of the album or the current public interest, this has to go down as a cla**ic hip hop album. It flew over a lot of headz - I will admit, it is a bit futuristic... Thats why it will be played 10 years from now. Its a masterpiece

I guess freedom of speech is just a myth then in South Africa. Yeah we're going through some racial tish, but that's not new... so what's wrong with a brother expressing his views, isn't this why hip hop is an art form. I'm not gonna argue with anyone, but whether or not I'm signed by a major or just pushing my own thing, at the end of the day the rest of the country needs to know how we feel as artists, and the constitution gives us a freedom of speech or so they say.

Why didn't the guy who shot a black man in a farm and excused himself by saying that he thought he (the black guy) was a monkey/baboon not in prison serving a life sentence. Why are the kids who shot and participated in that UFS video not prosecuted as of yet. And  I wonder WTF is up in South Africa!!!!!

This is just another boere k@k... I'm sorry but this is some "Bull Shit" like Qwazaar would say, feel me.

I hope Zubz wins it. I bought the album because of that joint in particular! who cares what thoes motherf***ers feel about the joint. These types of organisations should have their complaints ignored based on their party policies combined with the history of what they stand for!

i came across a norman connors record - You Are My Starship (Buddah, 1977) and a track on there sounds very similar - will up it so you can verify...its called 'The Creator has a master plan'

VERY GOOD LOOKS. Yeah sounds very similar. I will check the Zubz liner when I get my lazy a** out of bed to verify if this is credited as the original sample.
